Terms and Conditions

This document should be read in conjunction with our Acceptable Use Policy

At Goldhosts, we believe that all customers should be treated fairly. Therefore the terms and conditions we impose are all there to protect our customers, in one way or another.

1. Your personal details

We will not provide any of your personal information to other companies or individuals without your permission, unless we are required to do so by law.

2. Server use

Please see our Acceptable Use Policy.

3. Support

We endeavour to provide a continuous high quality service. If you experience problems with your service, you should contact us. Please bear in mind that our systems are constantly monitored. Support is usually free, but in exceptional circumstances where we spend time to find out that there is no problem with our systems, we may need to charge.

4. Maintenance

Please note we require suspension of some of our services for short scheduled periods to carry out maintenance, repair, updates and upgrades to our services. Be assured these are kept to a minimum, and are normally carried out outside of office hours.

5. Criticality

If you require a specifically high level of service, then please let us know in advance. Highly critical website and email service can be co-located for optimum availability.

6. Payment policies

Invoices are due immediately they are issued, Goldhosts do not offer account services. Payment is required within 7 days. Non-payment of any invoice, for any service, may result in the suspension or cancellation of all services held for that customer. Invoices issued for renewal of Domain Names must be paid in full before they will be renewed. Domain Names are registered in your name, but remain our property until paid for in full. Any property, including domains names, may be held until final payments have been made. Any fees incurred by Goldhosts in recovering monies owed, will also be payable. All payments are in UK sterling. Any prices are shown excluding UK VAT. See also section 12.

7. Intellectual Property

Design or code produced for a customer by Goldhosts becomes the intellectual property of the client upon cleared payment.

8. Expiry, Cancellation or Suspension

If any service, or domain is allowed to expire, or if it is necessary to cancel or suspend any service there maybe a charge for recovery or resumption.

9. Cancellation and refunds

Goldhosts reserves the right to cancel the service at any time. If a customer contravenes Goldhosts' terms of service a refund will not be issued.

10. Indemnification

Customer agrees that it shall defend, indemnify, save and hold Goldhosts harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Goldhosts, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Goldhosts against liabilities arising out of;

(1) Any injury to person or property caused by any products sold or otherwise distributed in connection with Goldhosts' server;

(2) Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;

(3) Copyright infringement and

(4) Any defective products sold to customer from Goldhosts' server.

11. Disclaimer

Goldhosts will not be responsible for any damages your business may suffer. Goldhosts makes no warranties of any kind, expressed or implied for services we provide. Goldhosts is not responsible for back up of your data/website and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, Goldhosts cannot guarantee to be able to replace lost data. Goldhosts disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Goldhosts and its employees. Goldhosts reserves the right to revise its policies at any time.

If you require Goldhosts to backup your data, then request this in writing, and we will cost this for you.

If you require high levels of service availability, then contact us, as we can build a system with reduced down-time. Unless specifically requested, a standard level of service will be provided.

12. Dedicated Server Payments

Payments for Dedicated Servers are due in advance. If these are not paid by the renewal date, service may be suspended without notice.
